Article 1 (Purpose)
The purpose of these Terms of Service ("Terms") is to define the rights, obligations, responsibilities, and conditions of use between IRON UNITED PTE. LTD. ("Company", "we", "us", or "our") and the user ("User", including both Members and Non-Members) regarding the use of the SIMTOSS global roaming service and any related ancillary or brokered services (collectively, the "Services").
Article 2 (Definitions)
The key terms used in these Terms are defined as follows:
"Services" means all digital and telecommunication services provided by the Company via web, mobile apps, or APIs, including eSIM data plans, USIM sales, and third-party travel service integrations.
"User" means any individual or entity that accesses and uses the Services, including both Members and Non-Members.
"Member" means a User who has registered an account by agreeing to these Terms and providing the required personal information.
"Non-Member" means a User who uses the Services without registering an account. Certain features or Services may be restricted for Non-Members.
"Verified Member" means a Member who has proven to possess specific professional qualifications (e.g., aviation industry personnel) through corporate/professional email verification, thereby granting access to exclusive tariff plans and benefits.
"Alliance Services" (Telecommunications Sales Intermediary Services) means third-party travel products (such as airport transfers, lounge passes, insurance) integrated into the Company's platform, where the actual contract and service execution are fulfilled by third-party "Partners."
Article 3 (Effectiveness and Amendment of Terms)
These Terms shall become effective when posted on the Service website or app, and when a User consents to them during account registration or checkout.
The Company reserves the right to amend these Terms at any time. In the event of an amendment, the Company will notify Users by posting the revised Terms on the platform or via email at least 7 days prior to the effective date. For material changes unfavorable to Users, notification will be provided at least 30 days in advance.
If a User does not agree to the amended Terms, they may terminate their account. Continued use of the Services after the effective date constitutes explicit acceptance of the revised Terms.
Article 4 (Account Registration & Age Restrictions)
Users who wish to become Members must provide true, accurate, and current information (such as Email/ID, Password, Name) as prompted by the Company.
Account registration is restricted to individuals aged 14 or older (or the legal minimum age specified by local regulations in the User's jurisdiction). If a User under the minimum required age is identified, the Company may immediately terminate the account and reject any active service contracts without a refund.
The Company strictly enforces a 'One Person, One Account' policy based on unique device/identity validation. If multiple accounts are found to belong to the same individual, the Company may merge the accounts, cancel duplicate promotional benefits, or suspend the redundant accounts.
Article 5 (User Obligations and Prohibited Activities)
Users shall not engage in any of the following activities:
Registering or purchasing Services with false or stolen identity information.
Reversing, decompiling, or disassembling any part of the SIMTOSS software, applications, or APIs.
Utilizing automated scripts, bots, or scrapers to overwhelm the Company's servers or cause denial of service.
Renting, leasing, or transferring a Verified Member account to an unqualified third party for illegal economic gains.
Defaming the Company, its staff, or its Partners, or obstructing business operations through abusive behavior, harassment, or malicious complaints.
Article 6 (Service Scope & Commercial Policies)
Coupons and Reward Points: Promotional coupons or reward points are non-transferable, non-refundable, and cannot be exchanged for cash. All unused rewards automatically expire upon account deletion or the specified expiration date.
Verified Services: Verified Members are under an ongoing obligation to notify the Company if they lose their professional status (e.g., resignation from an airline). Failure to notify may result in retroactive billing of tariff differences and account suspension.
Article 7 (Comprehensive Refund & Cancellation Policy)
1. SIMTOSS eSIM Services
eSIM products can be refunded within 30 days of purchase, provided the data plan has not been activated and no data has been consumed. Once an eSIM is installed on a device or activated on a local network, it is deemed fully consumed and non-refundable.
It is the User's sole responsibility to ensure that their mobile device is carrier-unlocked and supports eSIM technology. Refunds will not be granted for device incompatibility or carrier locks.
2. SIMTOSS USIM Services
Refunds for change of mind may be requested within 7 days of receiving the physical SIM card, provided the package remains completely unopened, unsealed, and undamaged.
For corporate or Partner channel sales, an administrative/return processing fee of USD 3.00 (or equivalent local currency) may be deducted from the refund amount if the cancel request is filed after shipment.
3. Technical Issues Abroad
Since roaming services operate on overseas telecommunication networks, any connection issue must be reported to SIMTOSS Customer Support while the User is abroad (using local airport Wi-Fi, public data, etc.) to allow for real-time troubleshooting.
Claims for refunds submitted after returning from the destination without any prior technical logs or tickets submitted during the trip will be strictly rejected.
4. Alliance Services (Airport Transfers / Chauffeur)
The Company acts strictly as an intermediary (broker) for airport transfer services. All cancellations, no-shows, and refunds are governed primarily by the individual operating policies of the local Partner executing the transit.
Refunds will not be provided for delays caused by incorrect flight numbers entered by the User, local customs delays, or failure to communicate with the driver.
Article 8 (Limitation of Liability & Indemnification)
The Company does not own or operate physical telecommunications infrastructure or vehicle fleets. All telecom data plans are provisioned via local carriers, and transport services are fulfilled by licensed local operators.
The Company shall not be liable for any service disruptions, speed drops, or outages caused by local telecom providers, roaming network maintenance, or local network force majeure events.
The Company shall not be held liable for any missed flights, consequential economic losses, or scheduling delays resulting from traffic congestion, adverse weather, or the local transport Partner’s operational negligence, except where caused by the Company's gross negligence or willful misconduct.
Article 9 (Governing Law and Dispute Resolution)
These Terms, their interpretation, and any contractual or non-contractual disputes arising out of or in connection with them shall be governed by and construed in accordance with the Laws of Singapore.
Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the Courts of Singapore.
